Terms and Conditions 

We reserve the right to amend these terms and conditions at any time without prior notice. You are free to not accept these changes but we would ask you to notify us in writing of your non acceptance within 14 days of your receipt, failing which we will be entitled to treat our agreement with you as being subject to the updated version.

By booking your child a space in an Empower class, you agree to accept the following terms and conditions.

Pre-school Classes:

By enrolling in an Empower class you are agreeing to take full responsibility for the safety and behaviour of your child throughout the class and whilst arriving and leaving venues. We ask that you sit with and supervise your child throughout the duration of the class. Children gain more from the class if they are supported and encouraged and we ask you to enjoy the classes together. We ask you to refrain from browsing your mobile phone and talking with other parents until the end of the class.

All of our sessions are created to be fun, high energy and educational. Our Tiny Tiger classes uses props which will require supervision from parents and we ask you not to allow your child to put any of the equipments in their mouth. Empower Arts does not assume liability for the health and safety of your child. Equipment must not be shared and is thoroughly cleaned between classes.

Booking Policy:

No place at an Empower Arts class is guaranteed until payment for the class or trial fees are received. Fees are paid via monthly direct debit. 

Classes are worked out as £8 per session x 39 weeks / 12 months + Go Cardless fees of 1% + 20p = £26.55 per month.

This means that your child is automatically enrolled every month until you cancel. Fees are still paid during the holidays to cover your child for the year. 

Direct debit payments are  made on the 1st of every month. 

If your child starts class before the 1st of the month then you will need to pay for classes before your direct debit starts e.g your child starts class 2 weeks before your direct debit comes out, you will then need to pay £16. Your child cannot attend class until all payments have been made. 

When signing up to an Empower Arts class, details of the class you are booked into, the dates and times and the venue are clearly displayed.

Monthly Payments:

We have a 4 week cancellation policy, you will need to let us know in writing if you wish to cancel. Your direct debits will be stopped after the 4 weeks has ended. If you cancel before this time, then we will be in touch. Your child will not be able to return until all fees are paid.

Refunds:

You have the right to cancel your booking provided you inform us within 7 days of booking. If you decide, once you have started the classes, that you no longer wish your child to attend, we will not give refunds or credits. Any refund under exceptional circumstances is discretionary.

 

Holiday:

We cannot offer discounts or refunds to cover your booked holidays. Instead, you may offer your place to a friend to attend a session you know you are unable to attend. Please ensure you inform your class teacher of this information.

 

Illness:

Please do not attend a class if your child or anyone in the household has had a contagious illness e.g. sickness, diarrhoea, chicken pox or impetigo. Take advice from your doctor and be clear of symptoms for 48 hours before returning. You must not attend classes if anyone in your household are displaying symptoms of Coronavirus.

Cancellation:

If a class is cancelled by Empower Arts, we will do our best to provide an alternative. If this is not possible, a refund will be given. Please ensure all contact details are kept up to date.

Health Declaration:

By attending an Empower Arts class, you agree to the following:

  • -  you have not travelled overseas in the the last 14 days

  • -  to the best of your knowledge, you have not been in direct contact with any person(s)

    known to have the COVID-19 virus in the last 14 days

  • -  you are fit and well and not displaying any symptoms consistent with COVID-19

  • -  you will notify your teacher if there is any change to the above, before, during or after any session

Infection Control:

Infection control measures are carried out as required. In order to prevent infectious diseases, including, but not limited to Covid-19, you may be asked to adhere to extra safety measures. Your class teacher will communicate any current measures. We cannot completely eradicate the risk of infection in our classes, therefore by attending classes, you do so at your own risk.

Lockdown:

If an area goes into local lockdown, classes will be offered online and a refund will not be offered.

Photography:

We ask that use mobile phones are on silent or put away during the class and that no photos and videos are taken of your child. We are happy for you to take photos before or after the class, but not during. Our classes are immersive and interactive, we want to avoid any distractions so that children get the most out of the session.  

Photographs and videos may be taken of participants during classes by the teacher (if you have given us photo permission to do so). These images may be used in the media, on DVDs and for general promotional purposes. Please let us know in writing if you wish for us not to use them as promotional purposes.

Confidentiality of Class Content:

All material delivered in our classes is owned by Empower Arts by copyright or trademark. Content must not be copied, downloaded, reproduced, distributed or transferred in any form without written consent from Empower Arts.

Adverse Weather:

Empower Arts will endeavour to run classes during bad weather e.g. snow, ice. However, should we need to cancel classes due to safety concerns, we will notify you by text, email and a post on social media. We will then do our best to provide an alternative class. Please ensure all contact details are kept up to date.

Loss/Damage:

Empower Arts cannot accept any responsibility for loss or damage of personal belongings before, during or after our classes.

Force Majeure Event:

Force Majeure means an event beyond the reasonable control of Empower Arts including but not limited to war, earthquakes, acts of governments, accident, fire, flood, pandemic, strikes.

Empower Arts shall not be liable to the customer as a result of any failure to perform its obligations under this contract as a result of a Force Majeure Event.

If the Force Majeure Event prevents Empower Arts from providing services, Empower Arts shall have the right to terminate classes immediately by giving written notice to the customer.

Data Protection:

We will process your personal and sensitive data in accordance with the Data Protection Act 1998. We will share your details with Empower Arts, but not with any other third party. We would like to keep you informed about future classes and events but if you would prefer not to be contacted please email info@empower-arts.co.uk.

Complaints Handling Policy:

Empower Arts are committed to providing the highest quality service. When something goes wrong, please tell us about it to assist us in constantly improving our standards.

In order to ensure our services remain at a high and improving standard, we have a procedure through which you can let us know of for any reason you are not satisfied with your dealings with the organisation.

 

We always aim to provide a prompt and peaceful resolution. We ask that you speak to your class teacher in the first instance and email info@empower-arts.co.uk. We will acknowledge receipt of your complaint as soon as possible, but always within a week. The complaint will be investigated and if the complaint relates to a person, they will have a fair opportunity to respond. We will call you to discuss and hopefully resolve your complaint. 

If this is not possible, an interim response will be made informing you of the action taken to date or being considered.

Empower arts has full Public Liability Insurance and all teachers have an enhanced DBS. We have relevant First Aid training and Safeguarding. Please inform your class teacher in the event of an incident.
